JOINT STUDY SESSION
PLANNING COMMISSION/ CITY COUNCIL
6:30 p.m. - City Council Chamber - Study Session - Development Code Project Discussion regarding Project Timeline; Environmental Review; General Plan map changes; and Affordable Housing, including Inclusionary Housing, Density Bonuses, and an Affordable Housing Incentive Program. Report by Barry Miller, Project Manager, and Cathy Munneke, Principal Planner.
Staff Recommendation: Hear the reports; take public comment; receive input from City Councilmembers and Commissioners.
CITY COUNCIL MATTERS - CITY COUNCIL CONSENT ITEMS:
- Approving - the minutes for the meeting of February 7, 2012. (No Fiscal Impact) Recommended by City Clerk.
- Approving - the rejection of the sole bid received for Project #2239, Sleep Train Pavilion Fire Sprinkler System Repair, for failure to provide required bond documentation at the time of bid submittal. (No Fiscal Impact) Recommended by Interim Director of Public Works.
- Confirming - the recommendation of the Concord Commission on Aging to appoint Suzanne Davis-Lucey to serve as the City's representative to the County Advisory Council on Aging; and requesting the City Clerk forward the recommendation to the County Board of Supervisors for their confirmation. (No Fiscal Impact) Recommended by the Commission on Aging.
- Approving - an agreement with Concord Bocce Federation to organize, promote and conduct bocce league play at Newhall and Baldwin Park bocce court facilities; and authorizing the Interim City Manager to execute the agreement. (No Fiscal Impact) Recommended by Director of Parks and Recreation.
- Approving - the acceptance of $60,000 in funds collected from corporate sponsors, grants and donations, and appropriating the funds to off-set expenses incurred to provide the public with Downtown Events at Todos Santos Park during the 2012 Event Season. Resolution No. 12-11 for adoption. (No Fiscal Impact) Recommended by Director of Community and Economic Development.
- Approving - the Sewer System Management Plan for the City of Concord and directing staff to submit the Plan in compliance with the State Order No. 2006-0003, which calls for statewide general waste discharge requirements for sanitary sewer systems. (No Fiscal Impact) Recommended by Director of Community and Economic Development.
- Matter to be set for Public Hearing - on March 27, 2012, at 6:30 p.m. in the Council Chamber - to consider an ordinance amending the Concord Municipal Code Chapter 6 (Amusements and Entertainments), Article III Bingo Games, bringing that Article into conformity with state law. Recommended by Acting City Attorney.
- Approving - a Professional Services Agreement with Renne, Sloan, Holtzman, Sakai, LLP for professional legal services in support of labor negotiations in the amount of $75,000 for Fiscal Year 2011-2012; and authorizing the Interim City Manager to execute the agreement. (General Fund) Recommended by Director of Human Resources.
- CITY COUNCIL CONSIDERATION ITEMS
- Consideration - of the appointment of Suzanne McDonald and Howard Jenkins to represent the City of Concord on the Oversight Board for the Successor Agency to the Redevelopment Agency of the City of Concord; and to authorize the distribution of a letter to various local agencies requesting they also appoint representatives to the Oversight Board. Report by Housing and Economic Development Manager.
Staff Recommendation: Hear the report, take public testimony, appoint Suzanne McDonald and Howard Jenkins to represent the City of Concord on the Oversight Board for the Successor Agency to the Redevelopment Agency of the City of Concord. - Consideration - of a Fiscal Year 2011-12 Mid-Year Budget Review and Year-End Budget Adjustments for Fiscal Year 2010-11 and other items. Report by Director of Finance.
Staff Recommendation: Hear the report, take public testimony, and adopt Resolution No. 12-10 amending the Fiscal Year 2011-12 Budget. - Consideration - of a draft letter to Local Agency Formation Commission (LAFCO) from the City of Concord regarding LAFCO's proposed dissolution of the Mt. Diablo Health Care District. Report by Interim City Manager.
Staff Recommendation: Review and approve the draft letter to be sent to LAFCO on behalf of the City Council.
CITY COUNCIL SITTING AS THE LOCAL REUSE AUTHORITY - Consideration - of the appointment of Suzanne McDonald and Howard Jenkins to represent the City of Concord on the Oversight Board for the Successor Agency to the Redevelopment Agency of the City of Concord; and to authorize the distribution of a letter to various local agencies requesting they also appoint representatives to the Oversight Board. - LOCAL REUSE AUTHORITY CONSENT ITEMS:
- Approving - a Professional Services Agreement with Craig Labadie in the amount of $96,000 to provide legal services associated with the Concord Community Reuse Project and the Redevelopment Agency Closure; and authorize the Local Reuse Authority Executive Director to execute the agreement. (Grant Funds) Recommended by the LRA Executive Director.

Speaker's Card: Members of the audience who wish to address the City Council are requested to complete a Speaker's Card available at the front bench. Submit the completed card to the City Clerk before the item is called, preferably before the meeting begins.
Agenda Reports: Agenda reports are available for public viewing in a binder on the front staff desk.
Public Comment Period: This is a fifteen-minute Public Comment Periodfor items not on this agenda, and each speaker will be limited to approximately three minutes. State law prohibits the City Council from acting at this meeting on any matter raised during the Public Comment Period.
Consent Calendar: Adoption of the Consent Calendar may be made by one motion of the City Council, provided that any Councilmember, individual or organization may request removal of an item from the Consent Calendar for separate consideration. If a request for removal of an item from the Consent Calendar has been received, the Mayor may defer action on the particular item and place the same on the regular agenda for consideration in any order s/he deems appropriate.
Public Hearings: Persons who wish to speak on Public Hearings listed on the agenda will be heard when the public hearing is opened, except on public hearing items previously heard and closed to public comment. After the public has commented, the item is closed to further public comment and brought to the Council/Agency level for discussion and action. Further comment from the audience will not be received unless requested by the Council/Agency. No public hearing shall commence after 10:00 p.m. unless approved by majority vote of the City Council.
ADA Notice and Hearing Impaired Provisions: The Council Chamber is equipped with Easy Listener Sound Amplifier units for use by the hearing impaired. The units operate in conjunction with the Chamber's sound system. You may request the Easy Listener Phonic Ear Personal Sound Amplifier from the City Clerk for personal use during Council meetings.

Notice: There is a 90-day limit for the filing of a challenge in the Superior Court to certain City administrative decisions and orders which require a hearing by law, the receipt of evidence, and the exercise of discretion. The 90-day limit begins on the date the decision is final (Code of Civil Procedure Section 1094.6). Further, if you challenge an action taken by the City Council in court, you may be limited, by California law, including but not limited to Government Code Section 65009, to raising only those issues you or someone else raised in the public hearing, or in written correspondence delivered to the City Council prior to or at the public hearing. The City Council may be requested to reconsider a decision if the request is made prior to the next City Council meeting, regardless of whether it is a regular or special meeting (Policy and Procedure No. 2, Section 4.24).
