    1. Presentation - to Corporal Kerry Cerletti proclaiming April 3, 2012 as Corporal Kerry Cerletti Day in the City of Concord in honor of his retirement and 27 years of service to the citizens of Concord. Presentation by Mayor Leone and Chief Guy Swanger.

  3. CITY COUNCIL STUDY SESSION:
    1. Study Session - Review of the Draft 2012-13 Action Plan containing recommendations for all community grant funding. Report by Marla Parada, Program Manager.

      Staff Recommendation: Hear the report; take public comment; receive input from City Councilmembers.
  4. CITY COUNCIL CONSENT ITEMS:
    1. Approving - the minutes for the meeting of March 6, 2012. (No Fiscal Impact) Recommended by City Clerk
    2. Authorizing - investment of City monies in the Local Agency Investment Fund for the General Account, the Sewer Enterprise Account, and the City as the Successor for the City Redevelopment Agency Account, and designating the positions in the City authorized to manage the funds invested in each of the Local Agency Investment Funds accounts. (No Fiscal Impact) Resolution Nos. 12-20, 12-21, and 12-22 for adoption. Recommended by Director of Finance.
    3. Designating - alternates to act on behalf of Councilmembers in a disaster or emergency situation. (No Fiscal Impact) Resolution No. 12-26 for adoption. Recommended by City Clerk.
    4. Approving - an amendment to the Site Access and Use Agreement with Motorola to add an additional location, the Pavilion Radio Bunker and Tower (2000 Kirker Pass Road), as a communication site to support the building of the BayWEB system and to provide on-going basic utility (electrical) service to operate the equipment at an estimated annual cost of $5,000; and authorizing the Interim City Manager to execute the agreement amendment. (General Fund) Recommended by Director of Information Technology
    5. Matter to be set for Public Hearing - on May 1, 2012, at 6:30 p.m. in the Council Chamber - to consider the Fiscal Year 2012-13 Action Plan for Community Grant Funding from Community Development Block Grant Funds and Child Care Developer Fees. (No Fiscal Impact)
    6. Authorizing - the submittal of an application to the Metropolitan Transportation Commission for two Priority Development Area (PDA) Planning Program Grants for the Downtown Concord BART Station PDA and Concord Reuse Project Area PDA in the amount of $680,000. Resolution No. 12-25 for adoption. (Program Grants) Recommended by Director of Community and Economic Development.
    7. Confirming - support for an initiative entitled "Choosing Civility" introduced by Joseph A. Ovick, Superintendent of Schools, Contra Costa County Office of Education. Resolution No. 12-23 for adoption. (No Fiscal Impact) Recommended by City Clerk.
    8. Accepting - the improvements for Project No. 2064 (Monument Corridor Pedestrian Infrastructure Improvements) constructed by Prism Engineering, Inc.; approve a budget transfer in the amount of $42,000; and direct the City Clerk to file a Notice of Completion. (Funded By: American Recovery And Reinvestment Act (Arra), Gas Tax, Measure C, Redevelopment Agency, And State Transportation Improvement Program - Transportation Enhancement (Stip-Te) Funds) Recommended by Director of Community and Economic Development.
  5. CITY COUNCIL CONSIDERATION ITEMS:
    1. Consideration - of a Recycling Theft Prevention Agreement with Concord Disposal Services under which Concord Disposal will fund the cost of assigning an existing Concord Police Officer on a part-time basis to provide heightened enforcement barring the theft of recyclable materials from commercial and residential containers. (Community Benefit). Report by Acting City Attorney

      Staff Recommendation: Hear the report, take public testimony, and approve the agreement with Concord Disposal Services, authorizing the Interim City Manager to execute the agreement.
    2. Consideration - of the submittal of an application to Local Agency Formation for Contra Costa County (LAFCO) to reduce the boundaries of the Mt. Diablo Health Care District and to establish the Mt. Diablo Health Care District as a subsidiary health district of the City of Concord. (No Fiscal Impact) Report by Interim City Manager.

      Staff Recommendation: Hear the report, take public testimony, and authorize the City Manager to submit an application to LAFCO to reduce the Mt. Diablo Health Care District boundaries and establish a subsidiary health district.

CLOSED SESSION: The City Council may convene in closed session immediately prior to or at the conclusion of the above meeting. If a closed session is to be held, an agenda will be posted on the Friday prior to the meeting. Notice to Public

Speaker's Card: Members of the audience who wish to address the City Council are requested to complete a Speaker's Card available at the front bench. Submit the completed card to the City Clerk before the item is called, preferably before the meeting begins.

Agenda Reports: Agenda reports are available for public viewing in a binder on the front staff desk.

Public Comment Period: This is a fifteen-minute Public Comment Periodfor items not on this agenda, and each speaker will be limited to approximately three minutes. State law prohibits the City Council from acting at this meeting on any matter raised during the Public Comment Period.

Consent Calendar: Adoption of the Consent Calendar may be made by one motion of the City Council, provided that any Councilmember, individual or organization may request removal of an item from the Consent Calendar for separate consideration. If a request for removal of an item from the Consent Calendar has been received, the Mayor may defer action on the particular item and place the same on the regular agenda for consideration in any order s/he deems appropriate.

Public Hearings: Persons who wish to speak on Public Hearings listed on the agenda will be heard when the public hearing is opened, except on public hearing items previously heard and closed to public comment. After the public has commented, the item is closed to further public comment and brought to the Council/Agency level for discussion and action. Further comment from the audience will not be received unless requested by the Council/Agency. No public hearing shall commence after 10:00 p.m. unless approved by majority vote of the City Council.

ADA Notice and Hearing Impaired Provisions: The Council Chamber is equipped with Easy Listener Sound Amplifier units for use by the hearing impaired. The units operate in conjunction with the Chamber's sound system. You may request the Easy Listener Phonic Ear Personal Sound Amplifier from the City Clerk for personal use during Council meetings.

Notice: There is a 90-day limit for the filing of a challenge in the Superior Court to certain City administrative decisions and orders which require a hearing by law, the receipt of evidence, and the exercise of discretion. The 90-day limit begins on the date the decision is final (Code of Civil Procedure Section 1094.6). Further, if you challenge an action taken by the City Council in court, you may be limited, by California law, including but not limited to Government Code Section 65009, to raising only those issues you or someone else raised in the public hearing, or in written correspondence delivered to the City Council prior to or at the public hearing. The City Council may be requested to reconsider a decision if the request is made prior to the next City Council meeting, regardless of whether it is a regular or special meeting (Policy and Procedure No. 2, Section 4.24). Televised Meetings: All meetings are broadcast live on Comcast channel 28, Astound Broadband channel 29, and AT&T U-Verse channel 99. The meeting is replayed on the Wednesday following the meeting at 8:00 a.m., 2:00 p.m. and 7:00 p.m. Replays are also broadcast on Thursday, Friday and Saturday.
