    1. Presentation - by Lt. Robin Heinemann on the Change for Real Change Program, positive help for the homeless. Introduction by Mayor Leone.
    2. Presentation - to Relay for Life of Concord Event Chair, Heather Brass. recognizing the Relay for Life event scheduled for July 7 -8, 2012 at Concord High School. Presentation by Mayor Leone.
    3. Presentation - to Jack Hlavak, General Manager of the Concord Hilton, proclaiming June 5, 2012 as "Hilton Concord Sustainability Flagship Day." Presentation by Mayor Leone.
  2. ANNOUNCEMENTS
    1. Announcing - the opening of a recruitment for applicants to serve on the City's Commission on Aging to fill two unscheduled vacancies on the Commission on Aging, and setting Friday, August 3, 2012 as the deadline for receipt of applications in the City Clerk's office. Recommended by the City Clerk.


    CITY COUNCIL MATTERS

  3. CITY COUNCIL CONSENT ITEMS:
    1. Approving - minutes of the meeting of May 1 and May 8, 2012. (No Fiscal Impact) Recommended by City Clerk.
    2. Adoption of Ordinance No. 12-3 - a City-initiated Municipal Code Amendment to Division 2 (Board of Appeals); Section 2-291 (Established; membership; compensation of members) revising the section to more accurately conform with the current California Building Code and remove residency requirements. Ordinance No. 12-3 was introduced on May 8, 2012. (No Fiscal Impact) Recommended by City Clerk.
    3. Approving - a Master Professional Services contract with Ebbin Moser + Skaggs, L.L.P. in an amount not to exceed $50,000, with the option of amendments at an amount not to exceed $20,000; and authorizing the City Attorney to execute the agreement on behalf of the City. (General Fund) Recommended by Reuse Project Director.
    4. Approving - the appointment of Councilmember Tim Grayson as the City of Concord's voting delegate, and Mayor Ron Leone as alternate, to the General Business Meeting of the League of California Cities Annual Conference being held September 5 through September 7, 2012 in San Diego, California. (General Fund Travel Expenditure) Recommended by City Clerk.
    5. Authorizing - the designation of the City Attorney to act on behalf of the City in matters relating to the California State Association of Counties Excess Insurance Authority (CSAC EIA) to comply with new requirements. Resolution No. 12-51 for adoption. (No Fiscal Impact) Recommended by Director of Human Resources.
    6. Matter to set for public hearing - on Tuesday, July 24, 2012 at 6:30 p.m. in the Council Chamber, to consider amending the Master Fees and Charges, Section E. Police Fees, Subsection 12 - Rotation Towing Services, amending Item a. - Application and Administration Fees adding a Rotational Towing Service Program Fee for each tow performed by a program participant, and to amend Item b. - Maximum Rates Chargeable by Rotation List Towing Operators - 1) Straight tow of one hour or less, increasing the rate to $175.00. Recommended by City Clerk.

  4. CITY COUNCIL PUBLIC HEARING:
    1. Landscape and Lighting Maintenance Districts - consider confirming the assessment diagrams and levying the annual assessments for Fiscal Year 2012-13 related to the following landscape and lighting maintenance districts. (Funded by Landscape and Lighting Assessment Districts) Report from Parks Manager, Steve Voorhies.

      1) Confirming the Assessment Diagram and Levy of Assessments for the Downtown Landscape Maintenance District for Fiscal Year 2012-13. Resolution No. 12-43 for adoption.

      Staff Recommendation: Adopt Resolution No. 12-43 confirming the assessment diagram and levying the annual assessment for 2012-13.

      2) Confirming the Assessment Diagram and Levy of Assessments for the Pine Hollow Estates Landscape and Lighting Maintenance District for Fiscal Year 2012-13. Resolution No. 12-44 for adoption.

      Staff Recommendation: Adopt Resolution No. 12-44 confirming the assessment diagram and levying the annual assessment for 2012-13.

      3) Confirming the Assessment Diagram and Levy of Assessments for the Landscaping and Lighting Maintenance District No. 3 for Fiscal Year 2012-13. Resolution No. 12-45 for adoption.

      Staff Recommendation: Adopt Resolution No. 12-45, confirming the assessment diagram and levying the annual assessment for 2012-13.

      4) Confirming the Assessment Diagram and Levy of Assessments for the Citywide Street Lighting Assessment District for Fiscal Year 2012-13. Resolution No. 12-46 for adoption.

      Staff Recommendation: Adopt Resolution No. 12-46 confirming the assessment diagram and levying the annual assessment for 2012-13

    2. BUDGET HEARING

      1. PRESENTATION - concluding the presentations begun at the May 8, 2012 Budget Workshop and addressing the questions raised at that meeting. Report by Interim City Manager Valerie Barone

      2. Approval of Fiscal Year 2012-13 Budget for the City of Concord, Ten-Year Financial Plans and Related Items - consideration for approval of Fiscal Year 2012-13 Budgets for the City of Concord, Ten-Year Financial Plans and Related Items, which include:
      1. Proposed Amendments to the Master Fees and Charges Resolution - consideration of amending the Master Fees and Charges Resolution for fees relating to various municipal services, including but not limited to Administrative Fees; Business, Professional and Trades Fees; Parks and Recreation Fees; Permit Center Fees; Police Fees; Off-Site Street Improvement Program (OSIP) Fees; and Parkland In-Lieu Fees. Data is available, as required by Government Code Title 7, Division 1, Chapter 8 Section 66016. Please contact Margaret Lefebvre, Director of Finance, at (925) 671-3078.
      2. Annual Appropriation Limits and Adjustment Factors - approving annual appropriation limits and adjustment factors for Fiscal Year 2012-13, pursuant to Article XIIIB of the California Constitution and reaffirming Policy & Procedure No. 129, "Budget and Fiscal Policies" in order to ensure the City's continued financial health.
      3. 2012-13 City of Concord Budget, Ten-Year Financial Plan and Capital Improvement Program - consideration of Fiscal Year 2012-13 City of Concord Budget and Ten-Year Financial Plan, and adoption of the 2012-13 Capital Improvement Program.
      4. Establishment of the Minimum Purchase Threshold for Fiscal Year 2012-13 over which City Council approval is required in accordance with Concord Municipal Code Article VIII Sec. 2-644(a).

        Staff Recommendation: Hear the report. Open the public hearing, receive testimony and continue the public hearing to Tuesday, June 26, 2012 at 6:30 p.m. in the Council Chamber.

CLOSED SESSION: The City Council may convene in closed session immediately prior to or at the conclusion of the above meeting. If a closed session is to be held, an agenda will be posted on the Friday prior to the meeting. Notice to Public

Speaker's Card: Members of the audience who wish to address the City Council are requested to complete a Speaker's Card available at the front bench. Submit the completed card to the City Clerk before the item is called, preferably before the meeting begins.

Agenda Reports: Agenda reports are available for public viewing in a binder on the front staff desk.

Public Comment Period: This is a fifteen-minute Public Comment Periodfor items not on this agenda, and each speaker will be limited to approximately three minutes. State law prohibits the City Council from acting at this meeting on any matter raised during the Public Comment Period.

Consent Calendar: Adoption of the Consent Calendar may be made by one motion of the City Council, provided that any Councilmember, individual or organization may request removal of an item from the Consent Calendar for separate consideration. If a request for removal of an item from the Consent Calendar has been received, the Mayor may defer action on the particular item and place the same on the regular agenda for consideration in any order s/he deems appropriate.

Public Hearings: Persons who wish to speak on Public Hearings listed on the agenda will be heard when the public hearing is opened, except on public hearing items previously heard and closed to public comment. After the public has commented, the item is closed to further public comment and brought to the Council/Agency level for discussion and action. Further comment from the audience will not be received unless requested by the Council/Agency. No public hearing shall commence after 10:00 p.m. unless approved by majority vote of the City Council.

ADA Notice and Hearing Impaired Provisions: The Council Chamber is equipped with Easy Listener Sound Amplifier units for use by the hearing impaired. The units operate in conjunction with the Chamber's sound system. You may request the Easy Listener Phonic Ear Personal Sound Amplifier from the City Clerk for personal use during Council meetings.

Correspondence: Correspondence received that constitutes a public record under the Public Records Act concerning any matter on this agenda is available for inspection during normal business hours by contacting the City Clerk's office at 1950 Parkside Drive, Wing A, Concord, CA

Notice: There is a 90-day limit for the filing of a challenge in the Superior Court to certain City administrative decisions and orders which require a hearing by law, the receipt of evidence, and the exercise of discretion. The 90-day limit begins on the date the decision is final (Code of Civil Procedure Section 1094.6). Further, if you challenge an action taken by the City Council in court, you may be limited, by California law, including but not limited to Government Code Section 65009, to raising only those issues you or someone else raised in the public hearing, or in written correspondence delivered to the City Council prior to or at the public hearing. The City Council may be requested to reconsider a decision if the request is made prior to the next City Council meeting, regardless of whether it is a regular or special meeting (Policy and Procedure No. 2, Section 4.24). Televised Meetings: All meetings are broadcast live on Comcast channel 28, Astound Broadband channel 29, and AT&T U-Verse channel 99. The meeting is replayed on the Wednesday following the meeting at 8:00 a.m., 2:00 p.m. and 7:00 p.m. Replays are also broadcast on Thursday, Friday and Saturday.
