CITY COUNCIL MATTERS - CITY COUNCIL CONSENT ITEMS:
- Approving - minutes of the meeting of June 26, 2012. (No Fiscal Impact) Recommended by City Clerk.
- Confirmation - of the April 24, 2012 appointment of Robert Mills to serve on the City's Board of Appeals for a term ending February 28, 2015. (No Fiscal Impact) Recommended by City Clerk.
- Authorizing - the acceptance of grant funding in the amount of $35,105 from the Federal Justice Assistance Grant (JAG) Program; and appropriating the funds to be used to fund one limited service position in the Police Department's holding facility. Resolution No. 12-61 for adoption. (Grant Funds) Recommended by Chief of Police.
- Approving - revises to Policy & Procedure 37.4 to preclude the hiring of related employees in the same department, the hiring of relatives of the Executive Team and elected/appointed officials, and relatives of existing employees irrespective of department where there is the potential for creating an adverse impact on supervision, safety, security or morale, or a conflict of interest exists. (No Fiscal Impact) Recommended by the Policy Development and Internal Operations Council Committee.
- Approving - an employment agreement between the City of Concord and Mark S. Coon, to serve as City Attorney. (General Fund) Recommended by Mayor Leone.
- Accepting - the improvements for Project No. 2155 (Refurbish/Upgrade Camp Concord Family Camp Bathhouse) constructed by Thomas Haen Company, Inc.; and direct the City Clerk to file a Notice of Completion. (No Fiscal Impact) Recommended by Director of Community and Economic Development.
- Awarding - a construction contract to SpenCon Construction, Inc. in the amount of $428,374 for the Base Bid and Alternate Bid for Project No. 2217 (Citywide Accessibility Improvements) and Project No. 2228 (Concord Blvd. Drainage Repair). (Community Development Block Grant, Insurance Proceeds And Civil Penalties, Measure J, Prop. 1B, and Stormwater Funds) Recommended by Director of Community and Economic Development.
- Awarding - a playground equipment and installation contract in the amount of $107,472.77 to Game Time of Novato for Project No. 2176 (Install New Playground Equipment at Newhall Park). (Measure WW & Parkland Funds) Recommended by Director of Community and Economic Development.
- Authorizing - the acceptance of funding under the California Beverage Container Recycling and Litter Abatement City/County Payment Program; and allocating the funds to the City's litter abatement activities. Resolution No. 12-59 for adoption.

- Consideration - of a proposed 12th Amendment to the Franchise Agreement with Concord Disposal Service including a proposed fee increase for residential solid waste collection, modification to franchise fees and customer service enhancements Concord Disposal Service including a proposed fee increase for residential solid waste collection, modification to franchise fees and customer service enhancements. Staff Recommendation: Hear the report; hold the public hearing; adopt Resolution Nos. No. 12-58 approving the 12th Amendment and Adopt Resolution No. 12-6042.3 amending the Master Fees and Charges. - Consideration - Consideration of a General Plan Amendment including text and map amendments, a City-initiated amendment to the Concord Municipal Code which would replace the City's existing zoning ordinance (Chapter 122) with a comprehensive new Development Code, including a Rezoning adopting a new Citywide zoning map. Amendments to the 2030 Concord General Plan are proposed to ensure internal consistency, more accurately depict exisiting uses, and reflect current economic conditions in Concord. Pursuant to the California Environmental Quality Act, a supplement to the Final Environmental Impact Report for the 2030 Concord General Plan has been prepared for this project and will be considered concurrently. Speaker's Card: Members of the audience who wish to address the City Council are requested to complete a Speaker's Card available at the front bench. Submit the completed card to the City Clerk before the item is called, preferably before the meeting begins.
Agenda Reports: Agenda reports are available for public viewing in a binder on the front staff desk.
Public Comment Period: This is a fifteen-minute Public Comment Periodfor items not on this agenda, and each speaker will be limited to approximately three minutes. State law prohibits the City Council from acting at this meeting on any matter raised during the Public Comment Period.
Consent Calendar: Adoption of the Consent Calendar may be made by one motion of the City Council, provided that any Councilmember, individual or organization may request removal of an item from the Consent Calendar for separate consideration. If a request for removal of an item from the Consent Calendar has been received, the Mayor may defer action on the particular item and place the same on the regular agenda for consideration in any order s/he deems appropriate.
Public Hearings: Persons who wish to speak on Public Hearings listed on the agenda will be heard when the public hearing is opened, except on public hearing items previously heard and closed to public comment. After the public has commented, the item is closed to further public comment and brought to the Council/Agency level for discussion and action. Further comment from the audience will not be received unless requested by the Council/Agency. No public hearing shall commence after 10:00 p.m. unless approved by majority vote of the City Council.

Notice: There is a 90-day limit for the filing of a challenge in the Superior Court to certain City administrative decisions and orders which require a hearing by law, the receipt of evidence, and the exercise of discretion. Further, if you challenge an action taken by the City Council in court, you may be limited, by California law, including but not limited to Government Code Section 65009, to raising only those issues you or someone else raised in the public hearing, or in written correspondence delivered to the City Council prior to or at the public hearing. The City Council may be requested to reconsider a decision if the request is made prior to the next City Council meeting, regardless of whether it is a regular or special meeting (Policy and Procedure No. 2, Section 4.24).
