  1. PRESENTATIONS
    1. Presentation - to heighten the awareness of safe driving and recognize the resilience of the Nuri Family. Introduction by Councilmember Grayson.
    2. Presentation - to Elizabeth Cofer, proclaiming Tuesday, September 25th as "Elizabeth Cofer Day" in the City of Concord, recognizing her for her volunteer efforts in the City of Concord. Presentation by Mayor Leone.
    3. Presentation - to Pete Emmons, Manager, and Gail Schultz, Promotion and Development Director, recognizing the Blue Devils for their undefeated season and for winning their 15th Drum Corps International World Championship on August 11th with a final score of 98.70. Presentation by Mayor Leone.
    4. Presentation - Linda Best, Chair of STAND! For Families Free of Violence Board of Directors, proclaiming October, 2012 as "Domestic Violence Awareness Month." Presentation by Mayor Leone.
    5. Presentation - by the Contra Costa County Fire Protection District regarding fire protection, suppression and first-responder emergency medical services provided by the Fire District, and consideration of a City Council position on Ballot Measure Q, a special fire district parcel tax, which will appear on the November 6, 2012 ballot for electorate consideration. Introduction by Mayor Leone.
  2. ANNOUNCEMENTS

    CITY COUNCIL MATTERS

  3. CITY COUNCIL CONSENT ITEMS:
    1. Approving - a 4-year Master Professional Services agreement with TRB and Associates, Inc. (TRB) in the annual amount not-to-exceed $200,000 to provide on-call building plan review and building inspection services; and to authorize the City Manager to execute the agreement. (General Funds Reimbursed by Permit Fees) Recommended by Director of Community and Economic Development.
    2. Matters to set for public hearing - on Tuesday, October 9, 2012 at 6:30 p.m. in the Council Chambers and waiving the three-week noticing period:

      1) Consideration - of City initiated "clean-up" amendments to the recently adopted comprehensive Development Code (adopted July 24, 2012; effective August 23, 2012). The amendments are proposed to correct minor technical errors and minor inconsistencies, and to add clarifying language, and do not change any of the major policy issues that were discussed at the earlier sessions and public hearings. The amendments include some changes to allowable uses in the land use tables.

      2) Consideration - of the approval of unanticipated expenses to address building code and safety requirements during the installation of energy-efficient, cost-saving heating and air conditioning systems at the Civic Center and Police Department under the Citywide Energy Services Company Energy Efficiency contract. Hearing is required to provide change order approval for the following:

      #1) upgrade of the structural supports for the HVAC at Civic Center ($153,913.07);
      #2) additional piping and electrical for energy efficient chiller at Civic Center to prevent vandalism ($25,065.93);
      #3) asbestos abatement and repair to City building required to install approved HVAC upgrade ($42,565.93); and
      #4) repair of existing equipment associated with management system at Concord Police Department ($211,125).
    3. Accepting - the improvements for Project No. 2202 (Camp Concord Green Room Deck) through a construction supplies contract with Home Depot U.S.A., Inc.; and direct the City Clerk to file a Notice of Completion. (Building Maintenance Funds) Recommended by Director of Community and Economic Development.
    4. Awarding - a Construction Contract in the amount of $462,066.50 to Grade Tech, Inc. of Castro Valley and approve a Professional Services Agreement Amendment with Nolte Associates, Inc. of San Jose in the amount of $95,558 for Design and Construction Support Services for Project No. 2169-1 (Monument Corridor Pedestrian and Bikeway Network Improvements); and authorize the City Manager to execute the Professional Services Agreement Amendment. (Measure J, CMA, STIP-TE & TDA Funds) Recommended by Director of Community and Economic Development.
    5. Approving - a Professional Services Agreement with West Coast Arborists, Inc. in the amount of $110,000 to provide tree maintenance services with the option of a one-year renewal, and authorizing the City Manager to execute the Agreement. (General Funds) Recommended by Director of Public Works.
  4. CITY COUNCIL CONSIDERATION ITEMS:
    1. Approving - the installation of all-way stop control at the intersections of Mt. Diablo Street/Laguna Street, Mt. Diablo Street/Mesa Street and Mt. Diablo Street/Bonifacio Street for an estimated total cost of $10,000. Resolution No. 12-3521.1 for adoption. (General Funds) Report by Ray Kuzbari, Transportation Manager.

      Staff Recommendation: Hear the report, take public comment, adopt Resolution No. 12-3521.1.
    2. Consideration - and discussion on the Preliminary Workplan, Schedule and Budget for the Downtown Specific Plan. Report by Joan Ryan, Senior Planner.

      Staff Recommendation: Hear the report, take public comment, provide input and direction to staff.
    3. Consideration - of the report presented earlier by the Contra Costa County Fire Protection District /,and discussion on the City Council's position on the Contra Costa County Fire Protection District's Ballot Measure Q, a special fire district parcel tax, which will appear on the November 6, 2012 local ballot.

      Staff Recommendation: Hear the report, take public comment, and consider Resolution No. 12-71, defining a position.
  5. CITY COUNCIL PUBLIC HEARING:
    1. Consideration - of a proposed Franchise Tow Agreement program for Tow Operators who perform towing at the request of the City of Concord and updates to the City's Policy and Procedure No. 137 to incorporate the new program and define the guidelines. This is a continuation of the hearing opened on September 11, 2012 at which time the City Council adopted Resolution No. 12-6042.4 approving the amendment of Master Fees and Charges, Exhibit C and continued action on the Franchise Tow Agreement and revisions to Policy and Procedure No. 137 to allow for further review. Resolution No. 12-70 for adoption. Report by Cheryl Owens, Administrative Services Manager.

      Staff Recommendation: Hear the report, continue the public hearing, and authorize the Franchise Tow Agreement program and adopt Resolution No. 12-70 approving the update of Policy and Procedure No. 137.
  6. CORRESPONDENCE - City Council correspondence not selectively included in the following list is available for inspection during normal business hours by contacting the City Clerk at 671-3495.
    1. Letter to Governor Brown dated September 14, 2012 from Mayor Leone requesting signature on Assembly Bill 2144 (Perez) Infrastructure Financing and Revitalization Districts.

Notice to Public

Speaker's Card: Members of the audience who wish to address the City Council are requested to complete a Speaker's Card available at the front bench. Submit the completed card to the City Clerk before the item is called, preferably before the meeting begins.

Agenda Reports: Agenda reports are available for public viewing in a binder on the front staff desk.

Public Comment Period: This is a fifteen-minute Public Comment Periodfor items not on this agenda, and each speaker will be limited to approximately three minutes. State law prohibits the City Council from acting at this meeting on any matter raised during the Public Comment Period.

Consent Calendar: Adoption of the Consent Calendar may be made by one motion of the City Council, provided that any Councilmember, individual or organization may request removal of an item from the Consent Calendar for separate consideration. If a request for removal of an item from the Consent Calendar has been received, the Mayor may defer action on the particular item and place the same on the regular agenda for consideration in any order s/he deems appropriate.

Public Hearings: Persons who wish to speak on Public Hearings listed on the agenda will be heard when the public hearing is opened, except on public hearing items previously heard and closed to public comment. After the public has commented, the item is closed to further public comment and brought to the Council/Agency level for discussion and action. Further comment from the audience will not be received unless requested by the Council/Agency. No public hearing shall commence after 10:00 p.m. unless approved by majority vote of the City Council.

ADA Notice and Hearing Impaired Provisions: The Council Chamber is equipped with Easy Listener Sound Amplifier units for use by the hearing impaired. The units operate in conjunction with the Chamber's sound system. You may request the Easy Listener Phonic Ear Personal Sound Amplifier from the City Clerk for personal use during Council meetings.

Notice: There is a 90-day limit for the filing of a challenge in the Superior Court to certain City administrative decisions and orders which require a hearing by law, the receipt of evidence, and the exercise of discretion. The 90-day limit begins on the date the decision is final (Code of Civil Procedure Section 1094.6). Further, if you challenge an action taken by the City Council in court, you may be limited, by California law, including but not limited to Government Code Section 65009, to raising only those issues you or someone else raised in the public hearing, or in written correspondence delivered to the City Council prior to or at the public hearing. The City Council may be requested to reconsider a decision if the request is made prior to the next City Council meeting, regardless of whether it is a regular or special meeting (Policy and Procedure No. 2, Section 4.24). Televised Meetings: All meetings are broadcast live on Comcast channel 28, Astound Broadband channel 29, and AT&T U-Verse channel 99. The meeting is replayed on the Wednesday following the meeting at 8:00 a.m., 2:00 p.m. and 7:00 p.m. Replays are also broadcast on Thursday, Friday and Saturday.
